The specific services provided will be detailed in a separate agreement or proposal (“Project Agreement”) agreed upon by both parties.

2. Project Agreement:

Each project will be governed by a separate Project Agreement outlining the scope of work, deliverables, timelines, payment terms, and any specific requirements. The Project Agreement will be considered an integral part of these Terms. In case of conflict, the Project Agreement will prevail.

3. Client Responsibilities:

The Client is responsible for:

Providing timely and accurate information and content required for the project.
Approving designs and deliverables promptly.
Providing necessary access to hosting accounts, domain registrars, and other relevant platforms.
Adhering to the agreed-upon payment schedule.
Ensuring they have the legal rights to use any content provided to The Website Maker.
4. The Website Maker Responsibilities:

The Website Maker is responsible for:

Delivering the services as outlined in the Project Agreement.
Meeting agreed-upon deadlines and milestones.
Communicating effectively with the Client throughout the project.
Providing reasonable support and maintenance as specified in the Project Agreement.

5. Payment Terms:

Payment terms will be detailed in the Project Agreement. Typically, projects involve a deposit upfront, with subsequent payments tied to milestones or project completion. Late payments may incur penalties as specified in the Project Agreement.

6. Intellectual Property:

Client Content: The Client retains ownership of all content provided to The Website Maker.
Website Design: Upon full payment, the Client will own the final website design as delivered. However, The Website Maker retains the right to showcase the design in their portfolio unless otherwise agreed upon in writing. Underlying code developed by The Website Maker may be subject to licensing agreements as specified in the Project Agreement.
Pre-existing Code/Software: Any pre-existing code, software, or third-party components used in the project will be subject to their respective licenses.

7. Confidentiality:

Both parties agree to keep confidential any information shared during the course of the project.

8. Revisions and Modifications:

The number of revisions included in the project will be specified in the Project Agreement. Additional revisions beyond this limit may be subject to additional fees.

9. Website Maintenance and Support:

The scope of website maintenance and support will be outlined in the Project Agreement. This may include updates, security patches, and troubleshooting.

10. Termination:

Either party may terminate the Project Agreement with written notice if the other party breaches these Terms or the Project Agreement. Upon termination, the Client will be responsible for paying for any work completed up to the termination date.

11. Disclaimer:

The Website Maker strives to provide high-quality services. However, we do not guarantee that our services will be error-free or uninterrupted. We are not liable for any indirect, incidental, or consequential damages arising from the use of our services.

12. Governing Law:

These Terms shall be governed by and construed in accordance with the laws of India, specifically within the jurisdiction of Kolkata, West Bengal.

13. Changes to Terms:

The Website Maker reserves the right to modify these Terms at any time. Any changes will be posted on this page. Continued use of our website or services after such changes constitutes acceptance of the new Terms.
